By using our website (bynouck.com), placing an order, or visiting our physical store, you agree to be bound by these Terms and Conditions (“T&Cs”). These T&Cs, together with our Privacy Policy and any additional guidelines published on our website, govern your relationship with Fashion Jewelry BV (“ByNouck”, “we”, “us”, or “our”). Where EU consumer law applies, your mandatory rights take precedence.

These T&Cs apply to all transactions via our website and store. By placing an order, you confirm that you have read and agree to these terms.

We may update these T&Cs at any time. The version in effect at the time of your order will apply. Dutch law governs these terms. Your EU consumer rights remain unaffected.

3. Ordering and Contract Formation

By clicking “Place Order”, you accept these T&Cs. You’ll receive a confirmation email.

Minimum order amount: €15.

Prices include 21% VAT and may change without affecting confirmed orders.

We reserve the right to correct typographical errors.

4. Payment Options

Available payment methods are shown during checkout. By ordering, you agree to pay the total shown.

5. Gift Cards

Gift cards can be used online or in-store using a unique code at checkout.

One gift card + one discount code per order.

Not redeemable for cash. Valid for 2 years.

Cannot be purchased using a discount code.

6. Delivery

Mailbox delivery is possible if it meets PostNL’s specifications.

Orders may be shipped in multiple packages.

You will receive tracking details once your order is dispatched.

7. Discount Codes

Codes are not valid on new collections, gift wrapping, pouches, gift boxes, gift cards, sample sale items, or Fill the Box.

One-time use per customer unless stated otherwise.

Codes are non-transferable, not retroactive, and have no cash value.

8. Returns and Warranty

You may return non-personalized items within 14 days at your own expense.

Items worn (e.g. earrings) and personalized jewelry are non-returnable unless faulty.

We offer a 6-month warranty for production defects, in addition to your EU rights.

Use trackable shipping for returns; we are not liable for lost parcels.

9. Intellectual Property

All content on bynouck.com is protected by copyright.

No reproduction or use without written permission.

10. Limitation of Liability

Our liability is limited to the purchase value of the product, unless otherwise required by law.

Your EU consumer rights remain fully applicable.

11. Force Majeure

We are not liable for failure due to events beyond our control (e.g., natural disasters, strikes).

If such an event lasts over 30 days, either party may cancel the agreement.

12. Data Protection

We respect your privacy. See our Privacy Policy for how we protect your data under the GDPR.

13. User-Generated Content and Social Media

By using #YesByNouck, you grant us a royalty-free, worldwide license to use your content for marketing purposes.

You confirm you own the content and that it does not infringe third-party rights.

No compensation will be provided.

To revoke permission, email info@bynouck.com. We’ll make reasonable efforts to stop future use.

14. Final Provisions

If a clause is unenforceable, the rest of the T&Cs remain valid.

These T&Cs and referenced policies form the full agreement between you and Fashion Jewelry BV.
